To paraphrase what Benjamin Franklin, one of the founding fathers of the United States, once wrote: “Without freedom of thought, there can be no such thing as wisdom – and no such thing as public liberty without freedom of speech.”
All Indian citizens are given the right to freedom of speech and expression under Article 19 (1)(a)(1) of the Constitution, but when misused, free speech can take the form of 'hate speech, which can have serious social and legal consequences. And in certain cases, by the time law enforcement agencies come into action, these speeches or texts have already affected a large number of people.
What are the exact laws governing hate speech? What does our justice system interpret as hate speech? Are the SC and HCs on the same page? As a lawyer, how do you present your case for or against?
