DECLARATION

I, _________________________, understand and agree that my participation in the Cummins India Power Run (hereinafter referred to as the “Event”) is conditional upon my execution of this document and submission of the fitness certificate from a registered medical practitioner, if applicable as per condition __________ mentioned above and I hereby declare, confirm and agree as follows:

 

1. I confirm that I meet the requirement of being 18 years old and above as on January 31, 2018 so as to participate in this event;

 

2. I declare that I am aware of the fact that participation requires good physical and mental health and declare I meet this requirement;

 

3. I have fully understood the risk and responsibility of participating in the Event and will be participating entirely at my sole risk. I am aware that running involves the possibility of injury or death and I am exposing myself to the same. I voluntarily agree to assume all risks and dangers including but not limited to the risk that I may be injured, physically or mentally either by my own acts or by the acts of other participants;

 

4. I am aware that my participation in the Event is at my own risk and that the Organiser is not liable for any damages, by whatever name, suffered by me. The Organiser shall also be not held liable in cases of serious damages such as all possible damages resulting from injury or death;

 

5. I agree that if I am injured or taken ill or otherwise suffer any detriment whatsoever, I hereby irrevocably and unconditionally authorize the Event officials and/or organizers or any entity/authorities and/or any contractor associated with the Event, it’s directors, employees or volunteers or any persons associated with the Event (hereinafter referred to as “Releases”) to, at my sole risk and cost, transport me to a medical facility and/or administer emergency medical treatment and I waive all claims that might result from such transport and/or treatment or delay or deficiency therein. I shall pay or reimburse to the Releases without contestation or demur the medical and emergency expenses and I hereby authorize the Releases to incur the same; 

 

6. In case of any illness or injury caused to me or death suffered by me by way of participation in the Event for any reasons whatsoever or due to any force majeure event including but not limited to fire, riots or other civil disturbances, earthquakes, storms, typhoons or any terrorist act, none of the Releases shall be held liable by me and/or my representatives;

 

7. I shall indemnify the Releases against all claims, damages, actions, losses, costs or expenses (whether arising under statute or otherwise) for negligence, personal injury, physical trauma, death, property damage, or infringement of any third party rights that arise as a result of any act, matter or thing done, permitted or omitted to be done by me by virtue of my presence at the venue of the Event;

 

8. I accept these risks, and all others arising from the Event, even if arising from the negligence, gross negligence on the part of other participants or by those associated in any manner with the Event or by the Releases;

 

1. I understand that all applicable rules for participation must be followed and that the sole responsibility for my personal safety remains with me, including my physical and emotional preparation and fitness to participate in the Event. I have obtained a medical clearance from a registered medical practitioner, allowing me to participate in the Event and the same shall be provided to the organisers of the Event on request. Non-production of a medical certificate may result in disqualification of my participation from the Event at the sole discretion of the organisers of the Event and the same shall be acceptable to me;

 

10. I give, a full release and waiver of liability and all claims, damages, actions, losses, costs or expenses (whether arising under statute or otherwise) that I have, or may have in the future against the Releases from all liability for any loss, damage, injury or expense that I may suffer as a result of my participation in any part or parts of the Event or my presence at any venue at which they may take place, due to any cause whatsoever including the forms of negligence set forth in paragraph (e) above or from any breach of contract or statutory duty or other care including any duty of care owed under the relevant law on the part of the Releases;

 

11. I hereby undertake and agree that I will not institute any legal proceedings and I further agree to indemnify and hold harmless the Releases from any and all expenses, fees, liability or damage award or cost of any type whatsoever arising from my participation in the Event.

 

50. I understand, agree that the data shared by me in the application is my personal information and I hereby irrevocably permit the organisers of the Event to use/share the information given by me in this application. All intellectual property rights in relation to the same shall solely and exclusively vest with the organisers of the Event;

 

1000. I understand, agree and irrevocably permit the Releases to use my photograph, the application form, and the photographs which may be taken on the Event day, for the purpose of promoting the Event or in any other matter related to the Event, at its own discretion and I shall have no objection to the same;

 

14. I understand and agree that in the event of any dispute arising between me and / or the Releases, the decision of the Releases shall be final. However if any dispute is to be adjudicated then the same shall be governed by the laws of India and the courts at Pune shall have exclusive jurisdiction for the same.
